Important Update: ERAP Program Returning to the Town of Brookhaven

The CDBG-CV COVID-19 Rental Arrears Program (ERAP) is returning to the Town of Brookhaven, set to reopen on July 28, 2023. This program aims to provide financial assistance to low to moderate income residents facing rental arrears due to COVID-19 hardships.

While the ERAP program intends to support tenants in need, we must remain mindful of past challenges faced by landlords:

Past ERAP Program Challenges for Landlords:

In the past, landlords who accepted the ERAP program faced a significant hurdle. As soon as the tenant signed the ERAP form, landlords were barred from evicting non-paying tenants for a period of 6 to 12 months. This situation caused considerable difficulties for landlords seeking to address non-payment issues promptly.

Important Considerations for Landlords:

As the ERAP program resurfaces, it is essential for you to weigh the potential consequences and exercise caution before participating:

Limited Funding: The ERAP program has a cap on funds and operates on a first-come, first-served basis. Once the funds are exhausted, there may be no additional financial support available.

Administrative Processes: Participating in ERAP may introduce administrative complexities, potentially affecting your property management efficiency.

Uncertain Rental Payments: Although ERAP offers assistance, it does not guarantee all tenants will receive funding, potentially leading to uncertain rental payments.

Tenant Eligibility: Not all tenants may qualify for assistance despite facing financial hardships, leaving landlords with non-paying occupants.

Program Restrictions: The ERAP program may come with certain restrictions that landlords must comply with, impacting your control over rental processes.

Taking Informed Decisions:

Before considering the ERAP program, we advise you to review the program guidelines thoroughly and fully understand its implications for your rental business. Seeking legal counsel, if needed, can provide further clarity on potential risks.

Staying Informed:

As a landlord, it is crucial to stay informed about any changes in eviction protection laws across New York. Being proactive in understanding local regulations will empower you to make well-informed decisions that align with your interests and those of your tenants.

For more information and to access the application and program guidelines, visit https://www.nslawservices.org or call LIHP at (631) 435-4710.

Please remember that submitting an application does not guarantee eligibility, and all Fair Housing laws will be followed.
